Welcome to HerbalMart ("HerbalMart," "we," "us," or "our"). These Terms
of Service explain the rules that apply when you browse our website,
create an account, contact us, or place an order through
https://herbalmart.com.pk.

By using our website or placing an order, you acknowledge these Terms.
If you do not agree, please do not use the website. These Terms do not
limit any consumer rights that cannot legally be excluded.

1. About HerbalMart

HerbalMart is an online retailer offering dietary supplements, vitamins,
minerals, herbal products, wellness products, and related health and
personal-care items to customers in Pakistan.

Business name: HerbalMart
Website: https://herbalmart.com.pk
Business location: Herbal Mart HQ, Model Town A, Pakistan
Phone / WhatsApp: +92 318 6763953

2. Using the Website

You may use the website only for lawful purposes and in accordance with
these Terms. You must not: - use the website for fraud, unlawful
activity, or misleading conduct; - attempt to access accounts, servers,
databases, or systems without authorization; - disrupt website security,
availability, or functionality; - upload malware or other harmful
code; - scrape, copy, reproduce, or commercially exploit website content
without permission; or - submit false information or use payment or
personal information without authorization.

We may restrict or suspend access where reasonably necessary to protect
customers, our business, or the website, or to address a suspected
breach of these Terms.

3. Product Information and Availability

We make reasonable efforts to present product names, descriptions,
images, ingredients, serving information, quantities, prices, and
availability accurately. However, manufacturers may update packaging,
labels, or formulations, and product images may differ from the item
delivered. Availability can change, and occasional typographical,
technical, or pricing errors may occur.

Please read the actual product label and packaging before use. If the
delivered item differs materially from the listing, is damaged, or
appears compromised, contact us before using it.

4. Health and Supplement Disclaimer

Product descriptions and other website content are provided for general
information only. They are not medical advice and are not a substitute
for advice, diagnosis, or treatment from a qualified healthcare
professional. Do not rely on website content to diagnose or treat a
medical condition.

Before using a supplement, consult a qualified healthcare professional
if you are pregnant or breastfeeding, have a medical condition, take
medication, have known allergies, are preparing for surgery, or are
unsure whether the product is appropriate for you. Follow the
manufacturer's label and serving instructions. Stop use and seek
appropriate medical advice if you experience a concerning reaction.

Unless expressly stated by the manufacturer and permitted by applicable
law, products are not represented as intended to diagnose, treat, cure,
or prevent disease. Individual results may vary. HerbalMart does not
guarantee a particular health outcome.

5. Product Authenticity and Inspection

HerbalMart aims to supply genuine products through its commercial supply
channels. On delivery, please check the product name, packaging, seal,
expiry or best-before date, batch or lot number, ingredients, supplement
facts, and physical condition.

Do not use a product if its seal is broken, the packaging appears
tampered with, or the product appears unsafe. Contact us promptly so we
can review the issue.

6. Prices, Taxes, and Offers

Prices are generally displayed in Pakistani Rupees (PKR). Prices,
availability, and promotions may change before an order is accepted.
Applicable delivery charges, taxes, or other charges will be shown or
communicated where relevant.

If an obvious pricing or technical error affects an order, we may
contact you before processing it. If the order cannot be fulfilled at
the correct price, we may cancel it and arrange any applicable refund
for amounts already paid.

Promotional offers are subject to the conditions shown when the offer is
made and may be changed or withdrawn prospectively, subject to
applicable law.

7. Orders and Confirmation

Submitting an order is a request to purchase the selected products; it
does not guarantee acceptance or availability. We may contact you to
confirm your name, phone number, delivery address, product selection,
quantity, payment method, or other details reasonably needed to process
the order.

We may decline, cancel, or place an order on hold where reasonably
necessary, including for product unavailability, an obvious pricing or
listing error, suspected fraud, payment problems, incomplete or
inaccurate details, delivery limitations, duplicate or unusual orders,
or a violation of these Terms. If we cancel an order for which payment
has already been received, we will arrange any applicable refund through
an appropriate method.

8. Payment and Cash on Delivery

Payment methods available at checkout may vary. Cash on Delivery (COD)
may be available for eligible products, orders, and delivery locations.
For COD orders, you agree to pay the confirmed amount when the courier
delivers the order.

Repeated refusal of confirmed COD orders without a legitimate reason may
lead to restrictions on future COD orders or a requirement to use a
prepaid method, where permitted by applicable law.

9. WhatsApp and Customer Support

We may use WhatsApp or other communication channels to confirm orders,
verify delivery details, answer questions, provide support, and handle
customer requests. These services are operated by third parties and are
subject to their own terms and privacy practices. Please avoid sending
unnecessary sensitive information through messaging services.

10. Shipping and Delivery

We offer delivery across Pakistan where courier coverage and service
availability permit. Delivery dates and timeframes are estimates, not
guarantees. Delivery may be affected by courier operations, weather,
public holidays, security conditions, inaccurate address details,
customer availability, or other circumstances beyond our reasonable
control.

You are responsible for providing a complete delivery address and a
reachable phone number. Please respond to courier or HerbalMart
communications needed to complete delivery.

Where free delivery is advertised, the conditions displayed at the time
of purchase apply. Promotional delivery offers may be changed for future
orders, subject to applicable law.

11. Cancellations, Returns, and Refunds

You may request cancellation before the order is dispatched. Once an
order has been handed to the courier, cancellation may no longer be
possible. Contact us as soon as possible if you need to cancel.

Returns and refunds are governed by our separate Return & Refund
Policy, which should be read alongside these Terms. Because many items
are consumable, health, supplement, or personal-care products, opened or
used products may be ineligible for return except where required by
applicable law or where the item is defective, damaged, incorrect, or
otherwise covered by the Return & Refund Policy.

If an order is damaged, incorrect, defective, incomplete, or missing an
item, contact us promptly. We may ask for the order number, photographs
of the product and packaging, courier details, or other reasonable
evidence to investigate and resolve the issue. Nothing in this section
removes rights available under applicable law.

12. Customer Accounts

If you create an account, you are responsible for providing accurate
information, protecting your login credentials, and notifying us if you
suspect unauthorized access. You must not impersonate another person or
use an account without permission. We may restrict access where
reasonably necessary for security or to address misuse.

13. Intellectual Property

Unless otherwise stated, original website content---including text,
graphics, photographs, branding, and design---is owned by HerbalMart or
used with permission. You may not reproduce, modify, distribute,
publish, or commercially exploit that content without prior written
permission, except as permitted by law.

Product names, logos, trademarks, and other brand assets belonging to
manufacturers or other parties remain the property of their respective
owners.

14. Third-Party Services and Links

The website may rely on third-party services such as payment providers,
courier companies, hosting providers, analytics tools, communication
platforms, advertising services, and social-media services. Third-party
services operate under their own terms and privacy practices. HerbalMart
is not responsible for independent third-party websites or services,
except to the extent responsibility cannot be excluded under applicable
law.

15. Website Availability and Security

We make reasonable efforts to keep the website available and secure, but
do not guarantee uninterrupted or error-free access. Maintenance,
updates, hosting or network problems, security measures, and other
events may temporarily affect access.

You must not attempt to bypass security controls or interfere with the
website. We may take reasonable steps to protect the website, customers,
and systems.

16. Limitation of Liability

To the extent permitted by applicable law, HerbalMart is not liable for
indirect or consequential loss arising from website use or product
purchases. Nothing in these Terms excludes or limits liability, a
consumer remedy, or a statutory right that cannot legally be excluded or
limited. This section does not replace any rights or remedies available
under applicable law.

17. Changes to These Terms

We may revise these Terms from time to time. The revised version will be
posted on this page with an updated effective date. Changes apply from
publication or any later date stated in the revised Terms, subject to
applicable law. Please review this page periodically.

18. Governing Law and Complaints

These Terms are intended to be governed by the applicable laws of
Pakistan. Disputes will be handled through the applicable legal and
consumer-protection mechanisms.

If you have a concern about an order, product, payment, delivery, or
website service, contact us first so we can investigate and try to
resolve it.

Website: https://herbalmart.com.pk\
Contact: +92 318 6763953 (Phone / WhatsApp)

This Privacy Policy explains how HerbalMart ("HerbalMart," "we," "us,"
or "our") may collect, use, disclose, and protect information when you
visit https://herbalmart.com.pk, create an account, place an order,
contact customer support, or interact with us through related services.

This draft describes expected e-commerce data practices. Before
publishing it, HerbalMart should verify that it accurately reflects the
website's actual analytics, advertising, payment, cookie, hosting, and
retention settings.

1. Information We May Collect

Depending on how you use the website, we may collect the following
categories of information:

Contact and delivery information: name, phone number, email
address if provided, delivery and billing address, and delivery
instructions.
Order information: products purchased, quantities, order number,
order status, payment method, delivery details, and customer-service
history.
Account information: login or account details needed to operate
your account. We do not ask you to send passwords through
customer-support messages.
Messages and support information: information you choose to
provide when contacting us by phone, WhatsApp, email, or another
support channel, including information relevant to an order or
complaint.
Technical and usage information: depending on website
configuration, your IP address, browser and device information,
pages viewed, referral information, approximate usage times, and
diagnostic or security logs.
Cookie and similar technology information: information collected
through cookies or comparable technologies, if enabled, for
functions such as keeping the website working, remembering
preferences, measuring traffic, or supporting advertising.

Please provide only the information reasonably needed for your request
or order. Do not send sensitive personal or medical information unless
it is genuinely necessary for a specific customer-service issue.

2. How We Use Information

We may use information for purposes such as: - receiving, confirming,
processing, and delivering orders; - contacting you about an order,
delivery, return, refund, or customer-service request; - managing
accounts and maintaining order records; - responding to questions,
complaints, and product-related enquiries; - detecting fraud, misuse,
security incidents, or suspicious transactions; - maintaining,
troubleshooting, and improving the website and shopping experience; -
understanding website traffic and performance, where analytics tools are
enabled; - sending promotional messages where permitted and, when
required, with your consent; and - meeting applicable legal, accounting,
regulatory, or law-enforcement obligations.

We aim to use information for legitimate and relevant purposes and not
to collect more than is reasonably needed for those purposes.

3. Orders, Couriers, and Service Providers

To fulfil an order, we may share relevant information with service
providers that help us operate the business, such as courier and
delivery companies, payment providers, website hosting and technical
providers, customer-support platforms, and analytics or security
providers where enabled.

For example, a courier may need your name, phone number, and delivery
address to deliver a parcel. A payment provider may process transaction
information needed to complete a payment. These providers may process
information under their own terms and applicable arrangements with
HerbalMart.

We do not intend to sell customers' personal information as a standalone
product. We do not disclose information to unrelated parties for their
own purposes except as described in this Policy, with your direction or
consent where appropriate, or where permitted or required by law.

4. WhatsApp and Other Third-Party Platforms

If you contact us through WhatsApp, social media, a payment service, or
another third-party platform, the information you submit may also be
processed by that platform under its own terms and privacy policy.
HerbalMart does not control the independent privacy practices of those
platforms.

Please review the relevant platform's privacy information before using
it, and avoid sharing unnecessary sensitive information in messages.

5. Cookies, Analytics, and Advertising

Our website may use essential cookies or similar technologies to support
core functionality, security, shopping-cart features, and user
preferences. If analytics or advertising tools are enabled, they may use
technologies to measure traffic, understand website use, or assess
advertising performance.

The specific cookies and tools used can change as the website is
configured. You can review available browser settings to manage or block
cookies, although some website features may not work properly if
essential cookies are disabled. Where consent is legally required for a
non-essential cookie or technology, it should be requested before that
technology is used.

Before publishing: confirm which analytics, advertising pixels,
session-recording tools, and cookie-consent tools are actually installed
on HerbalMart.com.pk. Remove any sentence above that does not match the
live setup.

6. Legal Bases and Choices

We may process information when it is needed to fulfil an order or take
steps you request, operate and secure the website, respond to you,
comply with legal obligations, or pursue other legitimate business
purposes that are not overridden by applicable rights. Where consent is
required, we will seek it and explain how it can be withdrawn for future
processing.

You can choose not to provide certain information, but we may be unable
to accept or deliver an order, verify a request, or provide a requested
service without the information needed for that purpose.

7. Retention of Information

We retain information for as long as reasonably necessary for the
purposes described in this Policy, including order fulfilment, customer
support, accounting, dispute resolution, security, and legal compliance.
Retention periods depend on the type of information and the reason it is
held.

When information is no longer needed, we will take reasonable steps to
delete it, anonymize it, or otherwise dispose of it, subject to
applicable legal, operational, and security requirements.

Before publishing: set internal retention periods for orders,
customer messages, technical logs, marketing records, and backups, and
ensure actual deletion practices match this section.

8. Information Security

We use reasonable safeguards intended to protect information against
unauthorized access, loss, misuse, alteration, or disclosure. No
website, transmission method, or storage system can be guaranteed
completely secure. You should use a strong, unique password for your
account and contact us promptly if you suspect unauthorized access or
misuse of your information.

9. International Processing

Some third-party providers may store or process information outside
Pakistan, depending on the services used to operate the website. Where
this occurs, information may be subject to the laws of the locations
where it is processed. HerbalMart should assess the providers it uses
and apply safeguards appropriate to the information and applicable law.

10. Children's Privacy

The website is intended for people who can lawfully make purchases or
use the relevant services. We do not knowingly seek to collect
children's personal information unnecessarily. A parent or legal
guardian who believes a child has provided personal information may
contact us to request review and, where appropriate, deletion, subject
to legal and operational requirements.

11. Your Requests and Privacy Choices

Subject to applicable law and our ability to verify your identity, you
may contact us to request access to, correction of, or deletion of
personal information associated with you, or to raise a concern about
how it is used. You may also ask to stop receiving promotional
communications. We may retain information that we need for order
records, legal obligations, security, fraud prevention, or dispute
handling.

To protect customers, we may ask for reasonable information to verify a
request before acting on it.

12. Marketing Communications

If we send promotional messages, we will do so in accordance with
applicable requirements. You can ask us to stop promotional messages by
following any unsubscribe instructions provided or contacting us. Even
if you opt out of marketing, we may still send necessary service
messages about orders, deliveries, account security, or customer
support.

13. Third-Party Websites

Our website or messages may contain links to third-party websites. Their
content, security, and privacy practices are outside our control.
Visiting another website is subject to that website's own terms and
privacy policy.

14. Changes to This Privacy Policy

We may update this Policy when our practices, services, or legal
obligations change. We will publish the updated version on this page and
revise the effective date. Please check this page periodically for
changes.
